Divine Mathematics: The Beginner's Guide to Islamic Inheritance Law (Ilm al-Fara'id)

The science of estate distribution and inheritance (Ilm al-Fara'id) occupies a uniquely exalted station in Islamic jurisprudence. The Prophet Muhammad ﷺ described it as 'half of sacred knowledge' (Sunan Ibn Majah) because it deals with the inevitable conclusion of all human earthly existence. Unlike secular legal systems that grant arbitrary testamentary freedom, the Quran establishes precise mathematical shares directly in Surah al-Nisa.

The Four Sequential Rights Over the Deceased's Estate (Tarikah)

Before any distribution to inheritors takes place, the estate must satisfy four strict legal priorities in exact chronological order:

  1. Funeral & Burial Expenses: Dignified, non-extravagant burial costs according to Islamic custom.
  2. Settling Debts: Paying all outstanding liabilities—including debts to individuals, unpaid zakat, or delayed dowry (Mahr Mu'ajjal).
  3. Executing Bequests (Wasiyyah): Honoring voluntary charitable gifts up to a strict maximum of one-third (1/3) of the remaining estate, strictly to non-heirs.
  4. Distribution Among Legal Heirs: Allocating the remaining estate among the Quranic primary heirs according to divine fractions.

Primary Categories of Heirs

  • Ashab al-Furud (Primary Quranic Sharers): Twelve designated relatives whose fractional shares (1/2, 1/4, 1/8, 2/3, 1/3, 1/6) are explicitly fixed in the Quranic text (e.g., spouses, mother, daughters).
  • Asabah (Residuary Heirs): Male agnates who inherit the remainder of the estate after primary shares have been distributed.
  • Dhawi al-Arham (Distant Relatives): Non-primary kin who inherit only in the total absence of primary sharers and residuaries.
